Elliott Sadler Fires Back at GEM With Legal Order
An attorney for Elliott Sadler has fired the first shot in what is sure to be a legal battle between Sadler and Gillett Evernham Motorsports.
John Buric, Elliott Sadler’s attorney, has filed an ‘application and order extending time to file complaint’ in Iredell County, North Carolina Superior Court.
According to court records the order seeks “injunctive relief, declaratory relief/specific performance, consequential and punitive damages as a result of Defendants anticipatory and actual breach of Plaintiffs’ Driving Services Agreement — Plaintiffs also seek general, consequential, treble and punitive damages, and attorney fees, as a result of Defendants’ tortuous interference.”
Last spring GEM signed Sadler to a multiyear extension of his contract to drive the car through 2010.
The order filed by Sadler’s attorney names GEM owner George Gillette along with Ray Evernham and AJ Allmendinger.

I am not sure Elliott is taking the right course of action? Under the circumstances I would suggest he will never drive again for GEM, and if he were to win his case I think I feel it will only make it harder for him to find a ride with another team? I am not suggesting he should not sue GEM. I am only saying I dont think it’s the right time to do what he is doing???

I think Sadler is entitled to monies from the two year contract that he signed in 2008. I don’t believe he should sue for anything else right now. Sadler is one of my favorite drivers
and announcers, and I hope he finds a ride in 2009 and wish him all the luck in the world.

i think that if he wins – should get the money for the contract – but would you want to work for someone that doesnt want you? NOT ME – but get the $$$ and maybe someone else can use him as a driver or a car chief.. How about SMOKE – he looks to be a great owner/driver team

Times are tough….What if he can’t find a ride. If he had a contract, they should honor it or he should sue. Drivers honor their contracts and drive until it expires, why shouldn’t owners do the same. Pay off and let him move on.

well I believe he is 110% right. I hope they make him drive or give him his $$’s 2 stay home. Nascar teams have gotten away with a lot. Hell yea. go for it !!

I JUST FEEL REALLY SORRY FOR SADLER HERE THE GUY GOES INTO THE NEW SEASON THINKING HE HAS A RIDE AND A COUPLE OF DAYS BEFORE CHRISTMAS HE FINDS OUT THROUGH THE GRAPEVINE THAT “DINGERBOY” IS TAKING OVER HIS RIDE!!WHETHER HE WINS OR NOT THEY SIGNED HIM UP FOR 2 YEARS SO IT SHOULD BE HONORED OR THE MONEY HE WOULD HAVE MADE FOR THOSE 2 YEARS SHOULD BE PAID THAT’S MY THOUGHTS ON IT!!

Well…. I dont particulary care for Sadler….. however, he (like everyone else) is entitled to the financial aspects of his contract. He should recieve his base driver salary, his projected winnings (based on his average performance last year) and whatever personel fee’s his sponsor contracts allow. It’s not right to allow big corporate America (sponsors) and team owners get away not fulfilling these contracts. Im quite sure that if Sadler was last years points champion and decided to leave and start his own racing team without fulfilling his side of the contract… that GEM and their sponsors would have his ass in court immediately. Sadler…. I dont like you, but I DO respect you and whats due to you. Dont roll over….
