Kyle Has Lost His License

 

Kyle Busch has lost his driver’s license for 45 days after pleading guilty to driving 128 in a 45 mph zone. The NASCAR points leader was ticketed last May while driving a yellow Lexus LFA sports car outside of Charlotte.

Busch appeared in court Tuesday where he received the 45 day license suspension along with a $1000 fine. Busch was also placed on 1 year of unsupervised probation. He pled guilty to the speeding charge and no contest on the reckless driving count.

Attorney Cliff Homesley represented Mr. Busch and tried to convince the court that Busch was a highly-skilled professional driver and that driving 128 mph on a public road wasn’t considered reckless when performed by Kyle Busch.

The attorney also argued that the Lexus had superior handling and braking capabilities compared to other cars on the road and that driving the Lexus at that speed would be like driving any other car at 60 mph.

The judge didn’t buy any of that.

Now the question is will NASCAR allow Busch to race without a driver’s license. The answer is almost certainly yes. But is that the right call – should Kyle Busch be allowed to race at the highest level of NASCAR with no driver’s license?

  2. HAHAHAHAHAAAA!! Good for the Judge. Just because he’s Kyle Busch does not mean he’s above the law. Personally, if NASCAR has a policy (written in pencil I’m sure) that says a drunk driving conviction can get you indefinately suspended for “actions detrimental to motorsports” then why not this. NASCAR should pull his license to drive for 45 days too.

  4. They just spanked him a little, as usual with someone that is high-profile. Since the State did their little thing, I think NASCAR should do their thing now.
    1) Finish the rest of the season starting in the rear of the pack (Sprint Cup &Nationwide Series).
    2) Don’t let him race for at least 2 races on both series.

    NASCAR, or Joe Gibbs need to make an example of his actions. He put people’s, especially children’s lives at stake.

  8. Yes, A drivers license applies to driving public highways. It is to insure that drivers are aware of traffic laws including safety regulations while driving on public roads. There are no traffic lights or stop signs on the Nascar tracks and the drivers are governed by Nascar rules and regulations. As long as he obeys Nascar rules, then I think he should be allowed to drive in Nascar.

    You have to remember, if the Motor Vehicle laws of the state a driver is licensed in were to apply to Nascar racing, there would be no Nascar because all of the drivers would be in jail.

  16. Everyone looks for any chance they canget to slam Kyle down. Kyle has got over the boos so you might as well get over it. He is a damn good driver and is proving himself this yr. He has the same right any of the race guys do to race in Nascar. What happened to him was his own private time and what you want to bet it was at night and no little kids on the road. Come on get a life…..

  20. A nationwide driver received a $300 fine and a short suspension for dui and hitting another car parked at a red light. His blood alcohol was 3 times the legal limit. He was not suspended by nascar. Actually KyleBusch gota stiffer sentence than most rednecks get for a dui in North Carolina.

  22. Take his license away for one month. If he can’t drive on the road, he should not be allowed to drive on the racetrack. He is an citizen just like the rest of us. If they let him to continue to race, then we should all be allow to drive if we got suspended for one month.

  32. Personally, he’s meant to be setting an example of excellence. The “above the law” attitude doesn’t set a good example to the young (and tomorrow’s) fans. I don’t think he should race while suspended.

    Further, one particular driver was refused entry to Canada (but still managed to get a visa) for the Montreal race. A DUI in the Carolinas is considered a criminal offence in Canada. Thus, “riminals are not welcome” attitude to people crossing the border. It works both ways….Canadians are not welcome in the US with that stigma, whether or not they are going to drive south of the border.

If NASCAR fines & suspends cars/drivers when the car fender drops an inch after the race, they find a carb hole 1/16 in larger that ‘spec,’ for ‘actions detrimental to’ the ‘sport,’ certainly transferring his careless, reckless track actions to a public road, to impress himself and his girlfriend, is CERTAINLY DETRIMENTAL to the sport, and he should be FINED and SUSPENDED for AT LEAST the 45 day period, if not till the season’s over!

    He should have gotten 45 years instead of days, When I opened my emails and saw from racing win that Kyle Busch has lost his license, that just made my day. It is true, you do not have to have a drivers license to race, I read it on the offical site of Nascar.Man, his lawyer tried to pull a fast one, didn’t he. Saying because Kyle Busch was a race car driver he could handle the speed, no joke. It is still speeding on a public highway. When they speed on pit road, they gete penaltys. Why not get a stiff fine and a few years of no license. I am surprised the pleaded guilty, he lies out of everything else. I bet when court was over, he went to a corner somewhere and whined and cried like the baby he is.

  52. He should not be allowed to race in NASCAR without a driver’s license. The club I am in requires us to have a valid driver’s license and we have to show it when we register at every race. His lawyer is an idiot by saying it’s ok because he’s a professional driver. As a professional driver, KB should know that speed is for the track and only the track – NOT public roads. One never knows when a deer, dog, or child will run out in front of them. He is very,very lucky that nothing really bad happened. Kyle can just sit out for the 45 days and/or until the Judge reinstates his license.

  56. Kyle should still be able to drive a race car as long it is on the race track. He got off easy. I got stoped for going 100 miles a hr. in a 70 mile interstate. I got my driver license suspened for a year and got 4 yr. probation. I gess he new some one. Oh by the way I traveled for a living and put over 60,000 miles a year on a car, and also raced cars some. When I went over a wall with the race car it was time to give it up. I wanted to live and racing was not to save back in the 60″s

  74. Unfortunately John, driving at the race track does NOT require a valid drivers licence, BUT you do get points on your personal licence and do go to court, NASCAR requires points to win a race……go figure !!!!!!

  76. I ve just heard from someone who worked for Nascar and it is true, you can race a car without having a valid license. Kyle is a good race driver,very determined to win and it would be great that someone like Kyle win the championship this year. He does give his all when he is racing and make races exciting. As for speeding on the road, I am not for that but only glad that he, his wife, or some child or dog or deer did not get killed. I just hope that in the near future, if he want to test drive a car for speed to maybe take it to some race track in the area or a mall parking lot at night when no one is around, like around midnight or something, but have someone make sure that the area is clear before he did the testing.

If a professional marksman shoots out the lights on a street just to check out the rifles accuaracy before he buys it shoudl he also just get a slap on the wrist?     Doesn’t matter if NASCAR requires one or not (I can’t imagine why they wouldn’t), the fact that Kyle is a scary good driver on the track is beside the point. There are rules prohibiting speeds of 128 on public roads. He has a responsibility to uphold the image of NASCAR. The public would be none to happy if he had killed a child speeding down the street.     Kyle will be driving on the streets, during this 45 day period,
    hope someone keeps an eye on him, hes great at breaking

  144. So, if I get a ticket for dui in say Nevada, I can go to California and drive under the influence because it is a different state ? And I can do this If i lose my lisence on a public road in Nevada because it’s a different state ? it’s not fine for me to take my Buick I got the DUI in to the local race track because they are two separate entities ! and if you argue the cars are different, I will argue that if i get a DUI in a Buick, I cant go get my Ford and drive it cause it’s a different car ! He got busted, make him sit and think about it. If you choose to be in the public eye, you have to be a touch more responsible because everyone is watching you.

  148. I agree with the judge. Regardless of his experience or vehicle type, at that rate of speed he was a menace. That’s like allowing a 90 year old man drive whatever speed wherever he wants because he has 70+ years of experience. Give me a break already. NO ONE should be above the law!!! Doing that only re-enforces the notion that we are all equal only some are more equal than others like politicians and Hollywood celebs.

    In Joe Gibbs book, their is a chapter entitled “Reaping What You Sow”. Think as Kyles car owner that should be required reading for him, Not only on the highway in NC, but on the race track, there is no doubt he is fast. But, the rest of his charachter and style leave ALOT to be desired. He is by NO MEANS a good representative of what Joe Gibbs claims to stand for, This last episode should be leaving both Mr Gibbs and NASCAR with alot of doubt as to whether he deserves to have what they so freely have given him. A man needs to show he is able to live up to the opportunities given him, Kyle does not man up to any of his mistakes, his disposition and charachter do not demonstrate any of the God fearing attributes Joe Gibbs does. This is a problem Mr Gibbs needs to address if he continues to pay Kyles paycheck???

  166. but it was not driving on the highways at an awesome speed, just to see how fast the car he was trying out could go…i have a brother that has raced for years…even with dale sr. , dale jr. and several more, and he is still racing…but i can say he will not get out on the highway and risk someone elses life…on that track thats their choice…but on the highway with the regular guys, it us bit their choice to run like they are on the track…so Bush should pay, just like the rest of us would have to…think about it…..what if it had hit someone u love…?????   168. Didn’t watch the truck race but saw some of the shows yesterday and saw where Kyle threw one of his famous fits and stomped off the track blaming everyone but himself for wrecking. Even the announcers said he was wrong and said he needed to look at the tapes. For all of you 3 fans of his on here, what happened to Kyle’s
    “maturity” this year. Looks like the same old Kyle to me, whine, cry, act like a kindergardener. I feel sorry for Elliot who is a fair racer but it seems anyone that gets close to Kyle is going to pay the price. If we are so unlucky to have him around till he is age 40 we will have to put up with his crap. I don’t see any of the other drivers pitching tantrums when they don’t win or have a problem.
    Maybe it is because they are gentlemen, show their frustrations behind closed doors or admit it was just racing. I knew this “mature” Kyle wouldn’t last long, he thinks he is the greatest thing to happen to racing..sorry Kyle but you aren’t and never will be. You may be able to drive a race car but that is about all you can do and that usually consists of wrecking someone to get ahead and then blame them if you don’t. Kurt’s wife took all she could take (hope she got a big settlement) wonder how long Kyle’s wife will put up with him. I only wish the announcers would quit talking about him all the time like he is some kind of gift from God and mention some of the good guys that show only class like Martin, Jr. Kenseth and others.   178. The 45 day suspension isn’t a very long time. I feel it should have been at least a year due to the nature of the offence (speeding 128 mph in a 45 mph zone). This endangered the lives of other people let alone his wife who was in the vehicle with him. I know he was cited for speeding but that was also a reckless driving offence. A minimum of 20 mph over the posted speed limit is considered reckless driving.

    No Busch should not be able to race without a licence. Why is he differant from the civilian on the road he shares. If he can’t drive himself to the track he should not be able to race on that track. Period. I’m not a Busch hater but the law should be upheld on and off the track. No licence no DRIVING.

  182. I don’t think he was. He was a fill in for Danica since she started and I believe he was with JRM before Danica. It might seem like he was screwed but JRM kept him in the 7 when Danica wasn’t racing. Also he could have shown another team and/or sponsor what he can do so he could find another ride. Also I’m pretty sure Kelley or someone else explained to him that if Danica comes full time he probably wouldn’t have a ride unless they were able to start a 3rd team. Josh also has driven for other teams for at least this year when Danica did race and also at the first RC race where Ron was in the 7. I’m pretty dog on sure if JRM had the finances to have a 3rd team full time they’d keep Josh or at least give him a little while longer since in the bad runs he’s had he also had some good runs.
